New minimum wage from January 1, 2022: table by region

From January 1, 2022, the new federal minimum wage in Russia is 12,130 rubles. The federal minimum wage (minimum wage) is established simultaneously throughout the entire territory of the Russian Federation. Minimum wage 2022: law

The minimum wage in 2022 depends on the cost of living for the working population in the second quarter of 2022. The Ministry of Labor approved the living wage per capita for the second quarter of 2022. The cost of living is:

Minimum wage in 2022: new size

Minimum wage is the minimum wage. In other words, the legally established minimum wage per month, provided that the person has fully worked the standard working hours during this period and fulfilled labor standards (labor duties) (Article 133 of the Labor Code of the Russian Federation).

From January 1, 2022, the federal minimum wage applied throughout Russia is 13,890 rubles. (Article 1 of the Law of June 19, 2000 No. 82-FZ). It was established by Federal Law No. 406-FZ dated December 6, 2021. The constituent entities of the Russian Federation have also established their own regional minimum wages. We will give their sizes below.

Which minimum wage should we focus on: federal or regional?

In a subject of the Russian Federation, in accordance with the agreement of such a subject, a regional minimum wage may be introduced (Article 133.1 of the Labor Code of the Russian Federation). It applies to employees in the relevant region, except for those who work in organizations financed from the federal budget and those whose employers have followed a special procedure for refusing to join the regional minimum wage.

The minimum wage established in the region of the Russian Federation cannot be less than the federal minimum wage. That is, in no region of Russia from January 1, 2022, the minimum wage can be less than 12,130 rubles.

However, it is worth saying that in cases where the regional minimum wage in a constituent entity of the Russian Federation is not approved, the minimum wage established by federal legislation is applied.

When to apply it is necessary to apply the federal minimum wage (RUB 12,130)

Employers must use the federal minimum wage when calculating wages, vacation pay, travel allowances and other payments that are calculated from average earnings. The minimum wage also affects three benefits: sick leave, maternity leave, and child care benefits up to 1.5 years.

When to apply regional minimum wages

In 2022, employers are required to apply regional minimum wages if they have joined the regional agreement.

Let us remind you that employers who, within 30 calendar days after publication of the agreement, have not sent a written reasoned refusal to accede to the document to the labor authority of a constituent entity of the Russian Federation will automatically join the regional agreement. If the employer sent such a refusal, then you can rely on the federal minimum wage. If the refusal is not sent, then the employer is obliged to comply with the provisions of the regional agreement.

About the minimum wage in the region

The minimum wage is established annually by the Government of the Russian Federation. According to the Labor Code and the Constitution, everyone has the right to receive decent pay for their work. It is impossible to predict the entire range of salaries in advance, but the employee has the right to at least a guaranteed minimum. The minimum amount cannot be lower than the amount calculated by Rosstat for the obligatory monthly payments of a citizen - below the subsistence level (ML). Here in Art. 133 of the Labor Code of the Russian Federation stipulates that the minimum wage must correspond to the minimum wage.

So far in Russia it has not been possible to equalize the minimum wage and the minimum wage. But this is a long-term task, prescribed in Article 421 of the Labor Code. So there are two indicators - the minimum wage and the local minimum wage, which, according to Art. 133.1 of the Labor Code of the Russian Federation can independently establish regional authorities for their citizens.

In the Stavropol Territory, a tripartite Commission has been created for these purposes, which includes representatives of the administration, employers and trade unions. Agreement on the new minimum wage is mandatory for all employers. For failure to comply, the employer faces:

  • administrative liability under Art. 5.27 of the Code of Administrative Offenses of the Russian Federation, the minimum amount is 1000 rubles. fine;
  • or criminal under Art. 145. 1 of the Criminal Code of the Russian Federation for 1 year in prison.

Regional minimum wages in 2022

In the constituent entities of the Russian Federation, a regional agreement can establish its own regional minimum wage.

The regional minimum wage depends on the subsistence level of the working population in the corresponding constituent entity of the Russian Federation. However, it cannot be less than the federal minimum wage, that is, in 2022 it cannot be lower than 13,890 rubles.

Further, all employers in the region are invited to join this agreement. But in practice, this is what happens: if a particular employer, within 30 calendar days from the date of official publication of the proposal to join the regional minimum wage agreement, does not submit a written reasoned refusal to join, then it is considered that the agreement applies to this employer. And, therefore, subject to execution by him.

The monthly salary of an employee working in the territory of a certain constituent entity of the Russian Federation and who has worked the full working time for the month must be no less than the regional minimum wage (Article 133.1 of the Labor Code of the Russian Federation).
