Legislation of the Russian Federation (Labor Code of the Russian Federation) in Art.
282 part 1 regulates that every officially employed citizen has the right to apply for a part-time auxiliary workload. You can work part-time either at the company where you are employed (internal part-time employment) or at a third-party company (external part-time job). Unlike the execution of job descriptions at the base organization, part-time work with a full work schedule is not permitted. The duration of execution of part-time instructions is not allowed to exceed 4 hours of working time. In other words, you can get a part-time vacancy for only 0.5 of the salary.
To enroll part-time, you must conclude an employment contract (Article 16 of the Labor Code of the Russian Federation). A written application for enrollment in a part-time enterprise is not a mandatory document and is not provided for by law.
Previously, for employment, the main written document was considered to be an application, since according to the old standards, the employment agreement was drawn up orally. Law of the Russian Federation No. 3543-I of September 25, 1992 adopted new norms according to which the employment contract between a candidate for a vacancy and the management of the institution must be concluded in writing. That is why, today, submitting an application for enrollment in an enterprise is not mandatory. However, today most personnel officers ask to write such a form, which is not a violation of the law.
Normative base
Ensuring employment of persons carrying out part-time work is regulated by the law of the Russian Federation in Chapter.
44 of the Labor Code of the Russian Federation, as well as the Resolution of the Min. labor and social development No. 41. The mentioned regulatory documents define the status of a part-time worker, the nature of his activities taking into account the conditions in the workplace, the rules for maintaining relationships, the work process, the salary level, as well as some social preferences.
Article 282 of the Labor Code of the Russian Federation regulates that part-time work includes permanent work performed during a period of time freed from main obligations as a permanent employee, who is subject to all local regulations of the institution from the date of signing the employment agreement.
Part-time work is allowed in multiple companies, provided that the person has the required skills and qualifications, and is also provided with free time to carry out additional duties.
The Labor Code of the Russian Federation allows two ways of part-time work:
- Internal. In this option, the employee has a part-time job at the base organization. At the same time, in addition to the signed employment agreement when joining the main institution, it is necessary to seal the agreement on part-time employment.
In fact, this method of combination is mutually beneficial for both parties. The employer provides work to a qualified specialist who has the opportunity to carry out job descriptions at an additional workplace, with a payment of 0.5 rates, and the specialist has the opportunity to earn auxiliary income.
- External – involves working for a third-party company. That is, an external part-time worker is a person who fulfills obligations at a third-party company in his specialization, under an auxiliary labor agreement, during the free period of time from his main responsibilities.
External combination is ensured by the fulfillment of obligations upon completion of working hours, on your days off, but at a third-party enterprise.
To summarize, it can be noted that legislative norms provide that a person has the right to:
- Work simultaneously in many companies. At the same time, employment in a company that is not part of the main job is considered external part-time work.
- Working at the company where the basic workplace is located, with additional fulfillment of obligations and with the necessary registration process, refers to internal part-time work.
Application for external part-time work
If a working citizen wants to work part-time for a third-party company, then no one has the right to prohibit him from doing so.
In case of such employment, he will need to submit an application. When making a written request to the management of a third-party enterprise for part-time enrollment in a company, in order to formalize an employment contract, the candidate must provide documents along with the submitted application, in accordance with Article 283 of the Labor Code of the Russian Federation:
- A copy of your passport or other proof of identification.
- Certificate of education or diploma confirming a profession that provides the right to work in the proposed vacancy.
- A certificate with information about production conditions at the main institution.
The implementation of a request for external combination is carried out in the same way as letters of a similar order.
How to write an application for an external part-time job in 2022?
To legitimize labor relations for external part-time work, an employment contract must be drawn up. In addition, you need to write a statement, which is declared in free form, but in compliance with the rules for drawing up business letters.
The petition is drawn up on A4 sheet. Some companies develop their own templates for such documents.
To correctly compile such a form, you need to contact personnel officers, where they usually have sample applications or look for examples on the Internet.
- Like every document of this kind, filling out the form begins with the “header”, which is located at the top of the sheet on the right. Information about the boss and the author of the petition is displayed here. At the same time, position, full name. the boss is written in the dative case, and full name. part-time job for a vacancy - in the parent.
- Next, in the middle of the sheet, the name of the letter is inserted. In this version, “statement”.
- In the text section, an application for employment for the proposed part-time vacancy is filled out.
- Upon completion of the letter, the date and signature of the candidate are affixed.
- After the resolution of the company management on the employment form, the paper receives the status of an administrative document for personnel workers who prepare the necessary materials for promoting a part-time worker to work.

- At the beginning of the application write the addressee, i.e. name of the employing company (can be abbreviated), position and full name of the manager (or employee temporarily performing his duties).

Application for internal part-time job
When combining within an enterprise, it is necessary to conclude a second employment agreement.
And the necessary documents at the enterprise are already available in the personnel department. In addition, you need to send a request for internal combination. At the same time, you need to pay attention to the fact that part-time work and filling a position are different concepts and the industrial relations here are not the same.
The application form is no different from similar employment letters.
For internal part-time work, no special agreement is needed, but an additional agreement is signed and the basic employment contract is adjusted.
Entry into the work book for part-time work is not carried out, but, at the request of the part-time worker, such an entry can be made (Article 66 of the Labor Code of the Russian Federation).
When working part-time, it is allowed to introduce a probationary period, but when replacing, it is not allowed to establish it.
How to write
To get an internal part-time job, a person needs to submit an application that displays the desired work schedule, work and rest schedule, salary, etc.
In addition, the form must be drawn up correctly in a free style, in compliance with the rules for writing business letters.
According to the Labor Code of the Russian Federation, internal part-time work is the implementation by an employee of additional workload, with the exception of the execution of his main job descriptions, within one institution after the main working day.
According to the Labor Code of the Russian Federation, a citizen has the right to a plurality of additional works, provided that he has time to complete them and each one is completed in accordance with the standards.
The process of assigning additional workload to an employee during internal part-time work includes the following:
- The parties agree on aspects of the relationship the day before.
- The employee registers a request in the name of the boss to enroll him in the recommended vacancy as an internal part-time worker.
- The HR department draws up an employment agreement, as an addition to the main employment contract, and an order for part-time work.
- The parties sign the documents drawn up, and the employee begins to fulfill his obligations.

What information does the application contain?
As noted above, an application for employment is not required by the standards, therefore it is written in a free style or according to the sample established by the company.
To compile such a form, you can use the rules regulated by Law No. 59-FZ of May 2, 2006 (as amended on November 3, 2015). Guided by law, this form must contain the following information:
- Company name.
- FULL NAME. head of the company.
- FULL NAME. candidate for a vacancy.
- Request for admission to a part-time job, displaying the vacancy and start date.
- Date of application.
- Applicant's signature.

Art. 283 of the Labor Code of the Russian Federation states that a citizen who has expressed a desire to work part-time in a company is required to present the following documents:

- Certificate of education and level of professionalism.
- Two photographs.
- Insurance form.
- Work book.
- Military ID.
- Certificate from the company for the main job.
- Documents for children.
- Questionnaire.

Differences between part-time and combination
Combination and part-time work are also radically different. Combination is a type of employment when an employee of one organization simultaneously occupies two full-time positions in it (i.e., an additional agreement is concluded to the employment contract and a note is made in the employee’s personal file, but no entries are made in his work book). And in case of part-time work, a person “from outside” is hired, a new employment contract is concluded with him and all documents related to employment are drawn up.
In addition, there is another fundamental point in combination. It is usually used in one group of employees of the enterprise, i.e. for example, a representative of the administrative corps can occupy a second position only within its boundaries (chief accountant - economist), a worker - only in the working segment (carpenter-joiner), etc. If the qualifications, education and work experience of an employee do not correspond to the position for which he is applying, then he is unlikely to be able to take it.
Combination will not be possible if another position requires the execution of some additional paperwork (for example, a special permit or medical certificate).
