The size of the minimum wage in 2022 for employers means the need to control payments to employees. If they have worked the entire time limit and fulfilled all obligations in full, then they must receive a salary not lower than a certain level. And this level has several meanings.

If the employee’s payment is less than the regional minimum wage in 2021, then the employer is obliged to establish an additional payment. You can do this in 2 ways:

  1. Enlarge report.

    This means that with any change in the minimum wage, a corresponding order will need to be issued, the texts of employment contracts will need to be changed, and the staffing table will need to be redone. It is also necessary to understand the remaining documents in which the salary is indicated.

  2. Indicate the additional payment in a separate act.

    The fact is that the entire salary is compared with the minimum wage, not the bare salary. That is, other payments and allowances are taken into account. This option is simpler because it eliminates the need to redo a huge number of documents.

    The second option is preferable, because it is enough to fix the compensatory additional payment only once. Accrual will occur automatically. That is, the employer will only need to look at the table of minimum wages by region of Russia, find the required indicator, and calculate the amount.

    Important: it is worth considering that additional payment to the regional minimum wage is not required if the employee did not work all the days as scheduled for various reasons. However, the shortcoming in this case must have good reasons. And they need to be identified.

The increase in the minimum wage in 2022 affected all employers in one way or another. If they charge their employees less than the required amount, they may face fines and other troubles. That’s why it’s so important to follow the Government’s resolution on the minimum wage.

Rules for establishing minimum wages in the regions

In addition to the minimum wage for labor determined at the all-Russian level, it is also possible to adopt a regional value for this value (Article 133.1 of the Labor Code of the Russian Federation).
By region, the minimum wage can be introduced for all categories of workers, with the exception of those who work in organizations financed from the Federation budget. For the latter, the minimum wage is always equal to its federal value. A regional minimum will only apply within the region that established it. For its value, differentiation is acceptable depending on sources of funding, scale, specific area and types of activities of employers. But at the same time, it cannot be less than the value established for the federal minimum.

For regions, the minimum wage is decided by a 3-party commission consisting of representatives of the government of the constituent entity of the Russian Federation, workers (trade unions) and employers. This decision becomes binding for all employers in the region if they do not submit a written refusal to implement this decision to the leadership of the constituent entity of the Russian Federation within 30 days from the date of its publication. For employers who refuse to apply the minimum wage introduced in the region, the federal value of this indicator will apply.

The Labor Code of the Russian Federation (Articles 133 and 133.1), when determining the minimum wage for labor, obliges to focus on the level of the subsistence minimum, and from 01.01.2021, the amount of the median wage. For the minimum wage introduced at the all-Russian level, this requirement must be met from 05/01/2018. But regions, as a rule, followed this approach in the past.

It is important to keep in mind that the minimum wage, including the regional one, should not include the regional coefficient and salary bonuses accrued in connection with work in areas with special climatic conditions, including in the Far North and equivalent areas localities They need to be accrued additionally (Resolution of the Constitutional Court of the Russian Federation dated December 7, 2017 No. 38-P).

Minimum salary in the Nizhny Novgorod region

The size of the minimum wage in Nizhny Novgorod and the region from January 1, 2022 coincides with the federal one. According to the Federal Law of the Russian Federation dated December 6, 2021 N 406-FZ “On amending Article 1 of the Federal Law “On the Minimum Wage”, from January 1, 2022, the minimum wage in the country is 13,890 rubles monthly.

The minimum wage in the Nizhny Novgorod region in 2022 also did not differ from the indicator established for the entire country in accordance with the Federal Law of the Russian Federation dated December 29, 2020 N 473-FZ, and amounted to 12,792 rubles.

The Nizhny Novgorod region is not among the regions in which there are any territorial allowances and regional coefficients that increase the minimum wage. There are also no local regulations on increasing the minimum wage in the region.

From 2022, the minimum wage depends on the median salary in Russia as a whole. The value of the median salary is calculated by statistics. In the first case, you need to issue an order and specify the rules for additional payment up to the minimum wage in the wage regulations. In the second, change the staffing table and make additional agreements with employees.

What minimum wage should be taken into account if an employee works in a branch?

According to the letter of Rostrud dated 09/08/2011 No. 2648-6-1, the wages of employees of organizations, including branches and representative offices, cannot be lower than the minimum wage established in the constituent entity of the Russian Federation in the territory of which the employee carries out his labor activity.
That is, if the parent organization is located in Moscow, and an employee works in a branch, for example, in the Krasnodar Territory, then he must receive a salary no lower than the minimum wage approved in the Krasnodar Territory.

Living wage in the Nizhny Novgorod region

The living wage in the Nizhny Novgorod region for 2022 is established by Resolution of the Regional Government dated September 15, 2021 No. 819.

This by-law establishes the following living wage indicators for 2022:

  • for the working population – 11,233 rubles;
  • for the working population – 12,244 rubles;
  • for a pensioner – 9,660 rubles;
  • per child – 11,312 rubles.

When an employer has the right to pay wages less than the minimum wage

The employer has the right to pay the employee less than the minimum wage in the following cases (Article 133 of the Labor Code of the Russian Federation):

  • the employee did not work a full month;
  • committed absenteeism, during which he was deprived of his salary;
  • did not fulfill the established volume of production standards;
  • released defective products;
  • the employee was on sick leave;
  • registered for part-time work;
  • took a vacation at his own expense;
  • downtime at work through no fault of the employer.

In these cases, the employer has the right to pay the employee a salary less than the established minimum wage, that is, in proportion to the time actually worked. It is also worth considering that if an employee is registered under a GPC agreement, the employer is not obliged to set the salary in accordance with the minimum wage.
