PM and minimum wage - what are they and why are they established?

The subsistence minimum is a conditional amount of money on which a person can live for a month, purchasing the most necessary products, goods and services from the consumer basket, as well as paying taxes.

The minimum wage is a government guarantee that determines the lowest possible salary.

PM serves as a kind of social indicator. If the income of citizens is less than the minimum, then the family is considered low-income. Obtaining such a legal status in the Omsk region is the basis for:

  • payment of monthly child benefit;
  • targeted social assistance;
  • assignment of benefits to the poor;
  • other social support measures.

The federal minimum wage for the working population for the 2nd quarter is also the value that determines the minimum wage for the next year.

The minimum wage affects the size of salaries, as it limits their lower level. In the amount of the minimum wage, they also receive benefits for temporary disability, pregnancy and childbirth in the absence of earnings in the billing period.

Regional coefficient

In the Omsk region, a regional multiplying factor of 1.15 has been established throughout the entire territory.

The above minimum wage amounts must be multiplied by this coefficient to obtain the final value of the minimum wage in the Omsk region.

By the way, according to Article 133_1 of the Labor Code of the Russian Federation, the minimum wage for employees of organizations financed from the federal budget is always equal to the federal minimum wage, i.e. 13,890 ₽. Regional increasing coefficients are also applied for this size.

PM value in Omsk and the region

The indicator is approved by the local government quarterly. The cost of living in the Omsk region for the 3rd quarter of 2019 was established in accordance with the decree of the regional government dated November 13, 2019 No. 365-P. Approximately, these values ​​will be valid until February 2022, in which it is planned to establish the PM for the 4th quarter of 2022. PM for the 1st quarter of 2020 will become known only in May.

In the 3rd quarter, the size of the PM is as follows:

  • in the region as a whole - 10,100 rubles;
  • for workers - 10,713 rubles;
  • for pensioners - 8,114 rubles;
  • for children - 10,313 rubles.

Women who gave birth to or adopted their first or second child, from January 1, 2022, have the right to count on a new payment. It is provided if the average per capita family income does not exceed twice the subsistence minimum.

Residents of the Omsk region can, based on an application, receive benefits in the amount of 10,437 rubles (Region of the regional government of August 14, 2022 No. 252-p). To receive benefits for a child under 3 years of age in the Omsk region, the income of each family member must be less than 21,728 rubles (multiplied by two monthly subsistence minimums of the working-age population for the 2nd quarter of 2022).

PM for additional payment to pension

The cost of living for pensioners in the Omsk region in 2022 in order to receive a federal supplement to their pension is set at 8,480 rubles. The indicator was approved by regional law dated October 1, 2019 No. 2189-OZ.

The “pension” PM in Russia, used to establish additional payment, is 9,311 rubles (according to Federal Law dated December 2, 2019 No. 380-FZ).

Pensioners whose income is less than the regional minimum wage will receive an additional payment from the federal budget.

About the minimum wage in the region

The minimum wage is the minimum wage that a person who has worked a full month at their main place of work can always count on. The amount is established by the Government of the Russian Federation on the basis of Rosstat reports on the standard of living of the population and the current cost of living (ML). The employer has no right to pay below the minimum wage. However, the minimum wage is the amount before tax. The employee will receive the amount minus 13% personal income tax.

All rules for establishing the federal minimum wage and regional minimum wage are contained in Articles 133 and 133.1 of the Labor Code of the Russian Federation. Thus, the regions themselves set the lower wage line. The salary in the subject is also tied to the PM (regional). The minimum wage in the region is set by a tripartite commission, which includes the Government, employer associations and trade unions.

The activities of TSK in the Omsk region are regulated by the Law approved by the Governor, No. 452-OZ dated 06/11/03. According to it, 9 representatives of each side take part in the Commission. The agreement is considered accepted if all three parties vote “for” (i.e., the majority of representatives from each of them).

The document is brought to public attention by publication in the Omsk Bulletin, Gazette of the Legislative Assembly of the Public Association, on the portals of the Government of the Russian Federation and the Governor of the Public Organization.

The agreement is mandatory for all companies in the region, because the regional minimum wage is essentially a regional minimum wage. The minimum wage is also tied to the amount of PM. And therefore, for violating the Agreement, the employer faces the same liability as for violating the payment of the minimum wage - administrative (1 thousand rubles), criminal liability (1 year of imprisonment).

Change in the minimum wage in 2022

Individual industries have their own payment standards. They are indicated in the corresponding agreement. The texts of the latter are published on the website of the Ministry of Labor of the Russian Federation and in a number of official publications. It is advisable to keep track of all this.

The increase in the minimum wage in 2022 affected all employers in one way or another. If they charge their employees less than the required amount, they may face fines and other troubles. That’s why it’s so important to follow the Government’s resolution on the minimum wage.

There are often situations when an LLC is registered in one subject of the Russian Federation, and its employees work in a branch of the LLC in another subject. In this case, what minimum wage should we be guided by when setting salaries for branch employees?

Employers have a period of 30 days during which they can send to the labor body a written refusal to join the regional agreement on the minimum minimum wage in a specific subject. Silence automatically means consent, that is, if they do not refuse, they join the agreement.

Important: it is worth considering that additional payment to the regional minimum wage is not required if the employee did not work all the days as scheduled for various reasons. However, the shortcoming in this case must have good reasons. And they need to be identified.

On January 1, a new minimum wage was introduced. Its value was 12,792 rubles monthly. It was assumed that this figure would be less. However, Russian President Vladimir Putin opposed it. He recalled that wages below the minimum wage are unconstitutional, so this should not be allowed.

The government has moved away from the minimum expenses required for survival and tied the cost of living to the median income. At the same time, they are connected by a coefficient that is not entirely clear how it is calculated.

The minimum wage is also taken into account when calculating benefits. When calculating benefits in 2022, data on earnings for 2022 and 2022 will be taken into account. The maximum payments will increase, and the minimum payments will also increase.

Salary

In all calculations of social payments, the minimum wage is taken into account, increased by regional coefficients, northern and other similar allowances. But the minimum wage under the regional agreement is not taken into account in the calculation of federal benefits.
