What is the cost of living and what is the minimum wage

The PM includes the cost of the consumer basket and mandatory payments (Federal Law No. 134-FZ dated October 24, 1997). The consumer basket consists of the minimum necessary set of food products, other necessary goods and vital services. The PM is determined for each quarter.

Agreement on the minimum wage in the Khabarovsk Territory between the Union "Khabarovsk Regional Association of Trade Union Organizations", the regional association of employers "Union of Employers of the Khabarovsk Territory" and the Government of the Khabarovsk Territory for 2021

Authorized representatives of the Parties to the regional tripartite commission for the regulation of social and labor relations - the Union "Khabarovsk Regional Association of Trade Union Organizations", the regional association of employers "Union of Employers of the Khabarovsk Territory" and the Government of the Khabarovsk Territory, hereinafter referred to as the Parties, guided by the Labor Code of the Russian Federation, the Federal Law of June 19, 2000 No. 82-FZ “On the minimum wage”, Law of the Khabarovsk Territory dated March 31, 1999 No. 114 “On social partnership in the sphere of labor”, taking into account the socio-economic conditions in the Khabarovsk Territory, concluded an Agreement on the minimum for wages in the Khabarovsk Territory (hereinafter referred to as the Agreement).

The parties agreed:

1. Establish the minimum wage in the Khabarovsk Territory in the amount of 12,792 rubles.

2. The minimum wage in the Khabarovsk Territory (12,792 rubles) is subject to a regional coefficient and a percentage bonus for work experience in special climatic conditions in the Khabarovsk Territory.

3. Employers operating in the Khabarovsk Territory, regardless of their organizational and legal form and form of ownership (with the exception of organizations financed from the federal budget), provide wages using the regional coefficient to wages in an amount not lower than established by the decision of the Executive Committee of the Khabarovsk Regional Council People's Deputies of July 18, 1991 No. 154:

1) for work in the Far North:

a) in the Okhotsk region - 1.7;

b) in the Ayano-Maisky district - 1.5;

2) for work in areas equated to the regions of the Far North (districts: Amursky, Vaninsky, Verkhnebureinsky, Komsomolsky, Nikolaevsky, named after Polina Osipenko, Solnechny, Sovetsko-Gavansky, Tuguro-Chumikansky, Ulchsky, the city of Komsomolsk-on-Amur) - 1.5;

3) for work in the southern regions of the Far East (districts: Bikinsky, Vyazemsky, named after Lazo, Nanaisky, Khabarovsky, Khabarovsk city) - 1.3.

4. The amount of the minimum wage established by this Agreement is not a limitation for the implementation of higher wage guarantees.

5. The agreement applies to employers operating in the Khabarovsk Territory in the manner established by Article 133.1 of the Labor Code of the Russian Federation, with the exception of organizations financed from the federal budget.

6. The agreement comes into force on March 1, 2022 and is valid until December 31, 2022.

7. The agreement and the offer to employers operating in the Khabarovsk Territory and not participating in the conclusion of this Agreement to join it are subject to placement (publication) in the newspapers “Priamurskie Vedomosti” and “Priamurskie Vedomosti”.

8. Monitoring of the implementation of this Agreement is carried out by the Parties in accordance with current legislation.

9. The Agreement is drawn up in three copies having equal legal force, one for each Party.

Dear employers!

On March 4, 2022, an Agreement on the minimum wage in the Khabarovsk Territory was concluded between the Union “Khabarovsk Regional Association of Trade Union Organizations”, the regional association of employers “Union of Employers of the Khabarovsk Territory” and the Government of the Khabarovsk Territory for 2022 (hereinafter referred to as the Agreement).

The agreement established the minimum wage in the Khabarovsk Territory in the amount of 12,792 rubles, on which a regional coefficient and a percentage bonus are calculated for work experience in special climatic conditions in the Khabarovsk Territory.

Employers provide wages using the regional coefficient to wages in an amount not lower than that established by the decision of the Executive Committee of the Khabarovsk Regional Council of People's Deputies of July 18, 1991 No. 154:

1) for work in the Far North:

a) in the Okhotsk region - 1.7;

b) in the Ayano-Maisky district - 1.5;

The minimum wage in the Khabarovsk Territory is provided by:

- organizations financed from the budget of the Khabarovsk Territory - at the expense of the budget of the Khabarovsk Territory, extra-budgetary funds, as well as funds received from entrepreneurial and other income-generating activities;

- organizations financed from local budgets - at the expense of local budgets, extra-budgetary funds, as well as funds received from business and other income-generating activities;

- other employers - at their own expense.

The agreement comes into force on March 1, 2022 and is valid until December 31, 2022.

In accordance with Article 133.1 of the Labor Code of the Russian Federation, I propose to join the Agreement.

If employers operating in the Khabarovsk Territory, within 30 calendar days from the date of official publication of this proposal to join the Agreement, have not submitted to the Committee on Labor and Employment of the Government of the Khabarovsk Territory a reasoned written refusal to join it, then this Agreement is considered to be extended to these employers from the date of official publication of this proposal and is subject to mandatory execution by them.

The said refusal must be accompanied by a protocol of consultations between the employer and the elected body of the primary trade union organization uniting the employees of this employer, and proposals for the timing of increasing the minimum wage of employees to the amount provided for in the specified Agreement.

From March 1, 2022, the monthly salary of an employee working in the Khabarovsk Territory and who is in an employment relationship with an employer in respect of whom, in accordance with parts three and four of Article 48 of the Labor Code of the Russian Federation, the Agreement is in force or to which the Agreement has been extended in the manner, established by parts six to eight of Article 133.1 of the Labor Code of the Russian Federation, cannot be lower than the minimum wage in the Khabarovsk Territory established by the Agreement, provided that the specified employee has fully worked the standard working hours during this period and fulfilled labor standards (job duties).

Why are minimum wages and PM established and what do they influence?

PM is the basic value for determining the minimum wage. In addition, citizens who receive an income for each family member below the minimum subsistence minimum are recognized as poor.

And recognition of families as low-income is the basis:

  • to receive benefits for a child under 3 years of age;
  • to establish benefits for a child from 3 to 18 years old;
  • to assign benefits to the poor;
  • to register low-income citizens for housing;
  • to provide social assistance.

In accordance with Art. 41 of the Social Code (law of the Yaroslavl region No. 65-z dated December 19, 2008), families with an income per person below the regional subsistence minimum are recognized as low-income.

In the Yaroslavl region, social payments have been established for the poor (local laws dated December 19, 2008 No. 65-z, dated November 28, 2011 No. 45-z):

  • monthly cash payment for women who gave birth to their third and subsequent children;
  • monthly allowance for children until they reach the age of 18;
  • monthly payment for additional food for women during pregnancy and nursing mothers;
  • free meals for schoolchildren;
  • targeted social assistance;
  • compensation for the cost of trips for children to sanatoriums and children's camps.

The minimum wage stipulates:

  • lowest salary limit;
  • the amount of benefits for temporary disability, pregnancy and childbirth in the absence of earnings in the billing period.

PM value in the Yaroslavl region for 2022

From January 1, the PM value for the 3rd quarter of 2019 will continue to apply, since the indicator for the 4th quarter of 2022 will be determined no earlier than February 2022, and for the 1st quarter of 2022 - in the 2nd quarter.

The size of the subsistence minimum in the Yaroslavl region for the 3rd quarter of 2022 (Decree of the Governor of the Yaroslavl region No. 312 of October 30, 2019) is:

  • per person - 10,277 rubles;
  • for workers - 11,308 rubles;
  • for pensioners - 8,372 rubles;
  • for minors - 10,268 rubles.

From January 1, 2022, women who have given birth to (adopted) the 1st or 2nd child receive the right to a monthly payment until the child turns three years old, if the income for each person in the family does not exceed 2 times the minimum monthly wage for able-bodied citizens for 2nd quarter of 2022. In the Yaroslavl region it is determined in the amount of 11,631 rubles. by decree of the governor of July 18, 2019 No. 223.

The benefit for 2022 is formed in the amount of the monthly minimum wage for children in the corresponding region for the 2nd quarter of 2022 (Federal Law No. 418-FZ dated December 28, 2017). In the Yaroslavl region it is 10,268 rubles.

Article 32 of local law No. 45-z dated November 28, 2011 introduced a monthly cash social payment to women in the event of the birth of a third child or subsequent children. The subsistence minimum per child to establish the amount of this payment is approved every year by regional law. For 2022 it is 10,682 rubles (regional law of November 12, 2022 No. 57-z).

Regional coefficients

In the Khabarovsk Territory there is no single regional coefficient, but various increasing coefficients are established in the amount of 1.2 to 1.7 depending on the region, settlement, type of enterprise activity, etc.

You need to multiply the above minimum wage by these coefficients to get the final value of the minimum wage in the Khabarovsk Territory.

By the way, according to Article 133_1 of the Labor Code of the Russian Federation, the minimum wage for employees of organizations financed from the federal budget is always equal to the federal minimum wage, i.e. 13,890 ₽. Regional increasing coefficients are also applied for this size.

PM of a pensioner for the purpose of supplementing his pension

A pensioner is assigned a federal social supplement to his pension when his monthly income is less than the minimum wage for pensioners in the region and no more than the minimum wage for pensioners in the country.

The size of a pensioner's monthly pension for these purposes is established by the law of the Russian Federation on the federal budget every year, and in the regions - by the law of this subject (Article 4 of the Federal Law of October 24, 1997 No. 134-FZ).

The living wage for pensioners in the Yaroslavl region in 2020 by local law No. 48-z dated September 11, 2022 is set at 8,646 rubles, in Russia - 9,311 rubles (Federal Law dated December 2, 2019 No. 380-FZ).

Living wage in the region

Based on the Decree of the regional governor No. 20 dated March 12, 2020. The following current indicators apply:

  • the cost of living per child in the Khabarovsk Territory is 15,248 rubles;
  • for a pensioner - 11,622 rubles;
  • for a working or at least able-bodied citizen - 15,328 rubles.

The per capita figure is 14,417 rubles.

What minimum is set for a person is specifically determined by which group this person belongs to. Thus, the salary for a child is usually less than for a worker, and for a pensioner it is less than for a child.
