Minimum wage in 2022: new size

Minimum wage is the minimum wage. In other words, the legally established minimum wage per month, provided that the person has fully worked the standard working hours during this period and fulfilled labor standards (labor duties) (Article 133 of the Labor Code of the Russian Federation).

From January 1, 2022, the federal minimum wage applied throughout Russia is 13,890 rubles. (Article 1 of the Law of June 19, 2000 No. 82-FZ). It was established by Federal Law No. 406-FZ dated December 6, 2021. The constituent entities of the Russian Federation have also established their own regional minimum wages. We will give their sizes below.

What was the minimum wage in the Saratov region in 2022 and earlier

The minimum wage for employees of the non-budgetary sector in the region was:

  • From May 1, 2022 - RUB 13,500. (according to 04/26/2021);
  • from February 1, 2022 - RUB 12,615. (according to December 27, 2019);
  • from January 1, 2022 - RUB 12,130. (federal minimum wage);
  • from January 1, 2022 - 11,280 rubles. (federal minimum wage);
  • from May 1, 2022 - 11,163 rubles. (federal minimum wage);
  • from January 1, 2022 - RUB 9,489. (federal minimum wage);
  • from May 27, 2016 - 7900 rub. (according to May 27, 2016).

For employees of budgetary organizations, the federal minimum wage applies.

How the President of the Russian Federation set the minimum wage for 2022

The minimum wage is set for each calendar year. It is determined in proportion to the median salary calculated by Rosstat for the previous year.

When setting the minimum wage, two rules must be observed simultaneously:

  • The minimum wage for the next year cannot be lower than the subsistence level of the working population as a whole in the Russian Federation for the next year;
  • The minimum wage cannot be lower than the minimum wage established for the current year (Article 1 of Law No. 82-FZ of June 19, 2000).

Russian President Vladimir Putin proposed to index the cost of living in 2022 “at a faster pace than inflation” - by 8.6%. He stated this at a meeting on social issues. You can view the materials at this link .

“The draft federal budget for next year now includes an indexation of the cost of living by 2.5%. Of course, this is not enough, because such parameters lag significantly behind the level of current inflation, which has accelerated in recent months,” Putin said.

He added that, according to the Constitution, the cost of living should not exceed the minimum wage (minimum wage). And he proposed to increase the minimum wage by 8.6% next year.

Eventually:

  • the cost of living in Russia in 2022 will increase by a thousand rubles - up to 12,654 rubles per month;
  • The minimum wage will increase by approximately 1,100 rubles - up to 13,890 rubles per month.

Let us note that before the address of the President of the Russian Federation, the minimum wage for 2022 was planned to be fixed at 13,617 rubles.

About the minimum wage in the region

In accordance with Federal Law 82-FZ, the minimum wage - minimum wage - at the federal level is established by the Government of the Russian Federation at least once a year. Its figure according to Art. 133 of the Labor Code of the Russian Federation is tied to the subsistence level. And the cost of living, in turn, is the monthly cost of the required volume of goods, services and payments. So the relationship is obvious: you need to receive as much as you need to spend.

The minimum wage is the same throughout Russia. But this is unfair for those regions where the cost of living is very high. Therefore, the Labor Code stipulates that regional authorities set the minimum wage in their territory independently. It must correspond to the subject’s subsistence level. This means that the regional minimum wage is a kind of local minimum wage. If an employer pays employees a salary less than the minimum wage, he faces liability (fine or imprisonment). Accordingly, the same punishment “shines” on him for paying a salary less than the regional minimum.

In the Primorsky Territory, to establish the minimum wage, a tripartite Commission of an equal number of 10 people is convened - representatives of government agencies, trade unions and employers. The operating principles of the Commission are based on:

  • Regional Law “On Social Partnership” dated December 26, 2014 N 531-KZ;
  • orders of the Administration on approval of a specific composition of parties.

The agreement is accepted only if all parties are in favor. The document is published in the regional publication “Primorskaya Gazeta” and is mandatory for all employers in the region.

Regional minimum wages in 2022

In the constituent entities of the Russian Federation, a regional agreement can establish its own regional minimum wage.

The regional minimum wage depends on the subsistence level of the working population in the corresponding constituent entity of the Russian Federation. However, it cannot be less than the federal minimum wage, that is, in 2022 it cannot be lower than 13,890 rubles.

Further, all employers in the region are invited to join this agreement. But in practice, this is what happens: if a particular employer, within 30 calendar days from the date of official publication of the proposal to join the regional minimum wage agreement, does not submit a written reasoned refusal to join, then it is considered that the agreement applies to this employer. And, therefore, subject to execution by him.

The monthly salary of an employee working in the territory of a certain constituent entity of the Russian Federation and who has worked the full working time for the month must be no less than the regional minimum wage (Article 133.1 of the Labor Code of the Russian Federation).

Fines for wages below the minimum wage

Establishing a salary for an employee in an amount less than the minimum wage will entail the following administrative fines (Part 6 of Article 5.27 of the Code of Administrative Offenses of the Russian Federation):

  • for officials of the organization (usually the manager) - from 10,000 to 20,000 rubles. Although, in a good situation, the manager can get off with a warning. But the violation will still have to be eliminated, that is, the employee will have to pay the missing amounts and raise his salary to the minimum wage;
  • Individual entrepreneurs – from 1,000 to 5,000 rubles;
  • for organization – from 30,000 to 50,000 rubles.

If such a violation is committed again, this will entail the following fines (Part 7, Article 5.27 of the Code of Administrative Offenses of the Russian Federation):

  • for officials of the organization - from 20,000 to 30,000 rubles. Another option is that the official may be disqualified for a period of 1 to 3 years;
  • for individual entrepreneurs – from 10,000 to 30,000 rubles;
  • for organization – from 50,000 to 100,000 rubles.

Regional coefficients

In the Primorsky Territory there is no single regional coefficient, but various increasing coefficients are established in the amount of 1.2 to 1.4 depending on the region, settlement, type of enterprise activity, etc.

You need to multiply the above minimum wage by these coefficients to get the final value of the minimum wage in the Primorsky Territory.

It turns out that the minimum wage, taking into account regional coefficients

varies within the following limits:

For all categories of workers

from 16,668 ₽ to 19,446 ₽
It is best to check with your employer, the local Ministry of Labor or the trade union which coefficient is used in your organization.

If an employee has a percentage increase in wages for work experience in the Far North and equivalent areas, then the minimum wage of such an employee will be even higher.

By the way, according to Article 133_1 of the Labor Code of the Russian Federation, the minimum wage for employees of organizations financed from the federal budget is always equal to the federal minimum wage, i.e. 13,890 ₽. Regional increasing coefficients are also applied for this size.
