New federal minimum wage from 2022: new amount

According to Article 1 of the law on the minimum wage (dated June 19, 2000 No. 82-FZ), from January 1, 2022, the minimum wage is fixed by federal law in the amount of the subsistence level of the working population in Russia as a whole for the second quarter of the previous year.

Order No. 550n of the Ministry of Labor and Social Protection of the Russian Federation dated August 24, 2018 determined the living wage for Russia as a whole for the second quarter of 2022. The order sets the cost of living for the second quarter of 2018 on average per capita at 10,444 rubles. Living wage:

  • for the working population is determined in the amount of 11,280 rubles;
  • for pensioners – 8,583 rubles;
  • for children – 10,390 rubles.

This means that in 2022 the minimum wage for the working population will be 11,280 rubles.

Note that from May 1, 2022, the minimum wage was 11,163 rubles per month. It turns out that from January 1, 2022 it will increase by only 1%. (up to RUB 11,280). Only 117 rubles.

Specifically about the Samara region

According to Law No. 107-GD of December 10, 2003, every year in the Samara region a meeting of a tripartite commission is held, in which representatives of the authorities, workers and employers, 12 people from each side, participate. The decision is made by a majority vote. But since 2022, the commission has no longer met, so there are no legal grounds for establishing its own minimum wage. The federal indicator is used in the region.

The adopted decision is published in official sources of the Russian Federation, Samara and the region. Such as:

  • official websites of the Government of the Russian Federation and the region.

The publication is necessary so that all employers can familiarize themselves with the regulatory act. All heads of enterprises are obliged to comply with the adopted decision. Non-compliance is subject to penalties in the form of a fine. For repeated violations, the manager may face a real prison sentence.

Regional minimum wages cannot be less than 11,280 rubles

Minimum wage values ​​are fixed at the federal and regional levels. As we have already said, at the federal level in Russia the minimum wage from January 1, 2022 is 11,280 rubles.

However, each region must also have its own minimum wage. It is established by the constituent entities of the Russian Federation through regional agreements on the minimum wage. The regional minimum wage is usually higher than the federal one. But it cannot be less! (Article 133.1 of the Labor Code).

Organizations must set wages no less than the regional minimum wage if they have joined regional agreements. “By default”, those employers who, within 30 calendar days after the official publication of the agreement, have not sent a written reasoned refusal to join to the labor authority of a constituent entity of the Russian Federation, join the regional agreement. If such a refusal occurred, then compare salaries with the federal minimum wage. If the refusal was not sent, rely on the regional minimum wage (Part 8 of Article 133.1 of the Labor Code).

If in the constituent entity of the Russian Federation in which the employer operates, a special agreement has established the size of the regional minimum wage, then the salary of employees should not be less than this amount (Article 133.1 of the Labor Code of the Russian Federation). However, if the employer does not want to join this agreement, then he has the right to issue a written refusal to join. Those who did not write such a refusal are considered to have automatically joined the regional agreement. Consequently, if they pay wages below the regional minimum wage, these employers face the same sanctions as if they pay wages below the federal minimum wage.

How and why they are installed

First, about the minimum wage. In accordance with the Labor Code of the Russian Federation (Article 133-133.1 of the Labor Code of the Russian Federation), it is established at two levels:

  1. Federal. This is exactly the same 11,280 rubles. According to the new rules, this amount is identical to the monthly minimum wage for the second quarter of 2018 for employees. It is enshrined in Federal Law No. 82-FZ and is updated annually.
  2. Regional. Setting your own minimum wage is the right, but not the responsibility of the region. Moreover, it cannot be reduced. Many constituent entities of the Russian Federation do not have their own minimum wage; they are guided by federal law. The regional minimum wage is fixed by a special tripartite agreement. Its parties include the regional leadership, representatives of trade unions and employers. Here the legislator has provided one trick: employers who did not participate in the development and conclusion of this agreement automatically join it and accept the obligation to pay wages not lower than the regional minimum wage. To avoid this, you need to send a reasoned refusal to the agreement to the regional authorities. The period is 30 days from the moment the document was officially published. No excuses that the employer saw the publication too late will help. There is only one way out - regularly check the website of the regional administration and the local print media that publishes regulations.

When can a salary be less than the minimum wage?

Sometimes the salary may be less than the minimum wage after January 1, 2022, since the salary includes not only the salary itself, but also compensation payments (for example, various allowances for working conditions), as well as incentive payments (for example, bonuses) (Art. 129 of the Labor Code of the Russian Federation). Therefore, if in a month an employee receives, taking into account all allowances and incentives, an amount greater than or equal to the minimum wage, then this is quite normal.

If, after deducting personal income tax, from the income due to the employee, he receives an amount less than the minimum wage (RUB 11,280), then this is normal.

Keep in mind: do not include bonuses for work in the Far North and the regional coefficient in the amount of the salary that you compare with the minimum wage. Accrue these payments on top of your salary. That is, the salary should be no less than the regional or sectoral minimum wage, without the regional coefficient and the “northern bonus.”

Why is a minimum wage needed?

  • it guarantees citizens of the country a minimum wage threshold for work. Otherwise, some employers could offer wages lower than the modest minimum wage, and the employee would have no legal grounds to force them to raise wages,
  • used to calculate benefits for sick leave, maternity leave and other social insurance purposes.

The employer is obliged to take into account the minimum wage when setting wages. The total amount that the employee receives (salary, allowances, bonuses) cannot be less. That is, it is permissible to determine the salary or tariff rate in a smaller amount. The main thing is the final figure.

The subsistence minimum, similar to the minimum wage, is determined for residents of Russia as a whole and separately for its regions. There is logic in this - the economic situation in different regions of the country can differ significantly. Is it possible to compare the standard of living and prices in Moscow and Sakhalin?

The PM value for the whole of Russia is established by the Government of the Russian Federation, for the regions - by the executive bodies of the constituent entities. Every quarter, the size of the PM must be updated and officially published in print media and on the Rosstat website on the Internet. There are no clear deadlines for this.

For the population of the Russian Federation as a whole, PM values ​​for the third quarter of 2018 have been published. There is a draft Resolution for the fourth quarter.

For able-bodied citizens, the monthly wage is 11,310 rubles (but to calculate the federal minimum wage, the value for the second quarter is used - 11,280 rubles), for pensioners - 8,615 rubles. The cost of living for children is set at 10,302 rubles.

The cost of living applies:

  • for calculating minimum wages, scholarships, pensions, subsidies and other social benefits,
  • when forming budgets, both federal and local,
  • to assess the standard of living of the population. Ideally, PM should reflect a person’s real need for products and things for a month, taking into account prices, but, as practice shows, it is very difficult to live on PM.

Linking the minimum wage to the subsistence level made it possible to slightly raise the level of the minimum wage for labor. But it’s difficult to live on this money. In this regard, there are already a number of initiatives - to break the connection between the two indicators and to increase the minimum wage.

Salary below the minimum wage: responsibility and fines

The employer must understand that he is at great risk if his employees receive wages below the minimum wage. The labor inspectorate may fine him. According to Part 6 of Art. 5.27 of the Code of Administrative Offenses of the Russian Federation, such a violation entails a warning or the imposition of an administrative fine on officials in the amount of 10,000 to 20,000 rubles; for legal entities - from 30,000 to 50,000 rubles.

For repeated violations, the fine for officials ranges from 20,000 to 30,000 rubles. or disqualification for a period of one to three years; for legal entities - from 50,000 to 100,000 rubles.

Salary is less than the minimum wage for a part-time worker

Experts from Rostrud draw attention to the fact that in case of part-time work, remuneration should not be lower than the minimum wage, calculated in proportion to the time worked - depending on output or on other conditions determined by the employment contract (Article 285 of the Labor Code of the Russian Federation).

Thus, the wages of a part-time worker should not be lower than the minimum wage, calculated in proportion to the time worked.

Regional minimum wage

According to Art. 133.1 of the Labor Code of the Russian Federation, in addition to the federal minimum wage, which is valid throughout Russia, regions can set their own minimum wage. It is determined taking into account socio-economic conditions and the cost of living of the working population in the corresponding subject of the Russian Federation.

By law, the minimum wage in a constituent entity of the Russian Federation cannot be lower than the minimum wage established by federal law. At the same time, regional authorities have the right to equate the minimum wage to the federal standard or increase it.

Employers have a period of 30 days during which they can send to the labor body a written refusal to join the regional agreement on the minimum minimum wage in a specific subject. Silence automatically means consent, that is, if they do not refuse, they join the agreement.

Minimum wage in Moscow for 2022

The minimum wage in Moscow is 20,195 rubles. established by Decree of the Moscow Government dated September 10, 2019 No. 1177-PP and is already in force from October 1, 2022.

Minimum wage in the Leningrad region from January 1, 2022

On November 28, 2022, a Regional Agreement on the minimum wage was concluded in the Leningrad Region for 2022, according to which the minimum wage here is set at 12,800 rubles.

It follows from this that the monthly salary of a person working in the Leningrad region and in an employment relationship with an employer subject to a regional agreement cannot be lower than the minimum wage in the Leningrad region if this person has fully worked the standard working hours during this period and fulfilled labor standards.

As stated above, in the regions the minimum wage can be established by regional agreement. In accordance with Part 2 of Art. 133.1. The Labor Code of the Russian Federation, the minimum wage in a constituent entity of the Russian Federation can be established for employees operating in the territory of the corresponding constituent entity of the Russian Federation, with the exception of employees of organizations financed from the federal budget.

Foreigners and wages not lower than the minimum wage

Minimum wage and northern allowances, regional coefficients

The minimum wage established by federal law does not include northern bonuses and regional coefficients. They are charged above the minimum wage.

Remuneration for labor in the regions of the Far North and equivalent areas is carried out using regional coefficients and percentage increases in wages (Article 315 of the Labor Code of the Russian Federation).
