Minimum wage in Bashkiria 2022: size according to regional agreement and without

The value of the minimum wage (minimum wage, or MW) in the Republic of Bashkortostan is applied according to the same rules as in the country as a whole. This economic indicator is a guarantee from the state that all employees in the region who worked full time for the whole month will receive a salary no less than this amount. If you work part-time (for example, part-time or with days off at your own expense), earnings may be lower than the state-guaranteed minimum - it is recalculated in proportion to the time worked.

The minimum wage in the Russian Federation is a legally approved value, recalculated at least once every 12 months based on:

  • laws No. 82-FZ, 421-FZ and 41-FZ.
  • Labor Code.
  • Resolutions of the Constitutional Court of Russia No. 38-P.

What is the minimum wage in Bashkortostan in 2022

In Bashkiria this year, a new regional Agreement on the minimum wage is in force (registration No. 2 of December 24, 2021).
It was concluded by the Federation of Trade Unions, the Union of Employers and the Government of the Republic.

The document came into force on January 1, 2022 and will remain in force until the conclusion of a new Agreement.

According to the document, the minimum wage in the Republic of Bashkortostan from January 1, 2022 is set at 14,200 rubles per month . Moreover, this is without payments for overtime, night work, weekends and non-working holidays, as well as without payment for combining professions.

“But the main thing is that the minimum wage specified in the Agreement does not include the regional coefficient, which in most regions of Bashkiria is 15 percent,” recalls Top-RF.ru ​​economic observer Dmitry Danilov.

Thus, the minimum wage in Bashkiria in 2022, in accordance with the regional agreement, is equal to 16,330 rubles per month, taking into account the Ural coefficient. (14,200 *1.15).

“The monthly salary of an employee working in the territory of Bashkiria in 2022 cannot be lower than this amount, provided that he has fully worked the standard working hours and fulfilled labor standards (job duties),” says Dmitry Danilov.

This amount is equally valid in Ufa, Sterlitamak, Salavat, Neftekamsk and other settlements of the region. The only exception is the ZATO Mezhgorye, where the regional premium is 70%.

Thus, the minimum wage for workers in the real sector of the economy in the republic in 2022 increased compared to the minimum wage last year by 1,619.2 rubles. or by 11%.

Who is covered by the minimum wage under the agreement and who is not?

The minimum wage approved by the regional Agreement is established for employees of organizations in the non-budgetary sector of the economy working in the territory of the Republic of Bashkortostan.

In order not to comply with the norms established by the document, employers must provide a reasoned written refusal to join it.

However, this Agreement does not apply to organizations financed from the federal, republican or local budgets, as well as state extra-budgetary funds. In addition, the document is not valid for non-profit organizations.

General provisions

The cost of living is calculated per person, the amount varies depending on the citizen’s membership in one of the main socio-demographic groups. Thus, in order to find out the PM for a person, you must first determine his socio-demographic group, which is not difficult.

Classification of PM is carried out according to population groups; indicators are distinguished based on this criterion:

  • for workers (every adult citizen for the purposes of applying the rules on PM is considered to be working);
  • for pensioners (there is also a separate PM for determining the amount of additional payments to pensioners, it will be discussed below);
  • for children.

When establishing the PM value, the overall average per capita is also calculated.

Since the PM is determined every three months or quarterly, accordingly, there are indicators for each quarter, for example, for the 4th quarter of 2022 or the 1st quarter of 2022, etc.

What is the minimum wage in Bashkiria for state employees

The minimum wage for budgetary institutions in Bashkortostan is set at the level of the federal minimum wage, which in 2022 is equal to 13,890 rubles per month (Law dated December 6, 2021 No. 406-FZ).

Thus, the minimum wage for public sector employees in Bashkiria, taking into account the Ural coefficient in 2022, is 15,973.5 rubles. per month (13,890*1.15).

For the closed administrative-territorial formation of Mezhgorye, where the regional bonus is 70%, the minimum wage for public sector employees increases to 23,613 rubles. per month.

If the employees' wages are less than the minimum wage, the employer may be held administratively liable.

Clarifications on changes in the minimum wage from January 1, 2022

The minimum wage is established simultaneously throughout the entire territory of the Russian Federation by federal law and cannot be lower than the subsistence level of the working population. Why is the minimum wage regulated by a regional agreement?

Regions of the Russian Federation are empowered to independently establish a minimum wage equivalent to the federal one or an increased one. For this purpose, a tripartite agreement is concluded between the administration, associations of employers and trade unions (Article 133.1 of the Labor Code of the Russian Federation).

In the Republic of Bashkortostan, this right has been used for many years. However, the last time the minimum wage in the Republic of Belarus was established was in 2016.

Legislative regulation

The basic standards are set out in the federal law on the subsistence minimum (details: number - 134-FZ, date of adoption - October 24, 1997). According to this act, the regions must adopt appropriate local laws on the procedure for determining the indicator. Every three months, the executive body of a constituent entity of the Russian Federation must accept and promptly publish data on PM for the quarter.

For the 3rd quarter of 2022, the PM of Bashkiria was established by Decree of the Government of the Republic No. 715 of December 9, 2019. And the procedure for determining the PM is enshrined in Republican Law No. 219-z dated 06/05/2001.

  • for pensioners - 7,801 (traditionally less than for other groups, taking into account the decrease in consumption, as stated in legislative acts);

The importance of PM for social policy

In Art. 2 Federal Law-134 enshrines the role of the indicator, its importance not only for assessing the standard of living, establishing the size of the minimum wage, scholarships, social benefits, but also for forming the budget, both federal and regional.

For benefits to the poor, the indicator is of direct importance, since in accordance with Art. 6 of the federal law, it is on the basis of it that a decision is made to assign this status to a family or citizen. If the average per capita (obtained by dividing the total income by all family members including dependents) or the individual income of a citizen living alone is less than the minimum wage established in a particular region, the family or citizen is recognized as low-income with the right to receive appropriate benefits.

In the regions, another indicator is separately established - PM for pensioners in order to determine the regional surcharge to the cash allowance received from the state. This is a requirement of Art. 12.1 Federal Law-178, this type of PM is used as follows: if the entire amount of material support for an elderly citizen (including pension and various additional payments) turns out to be below the established parameter, the region is obliged to make an additional payment to the PM.

The cost of living in Bashkiria for 2022 for pensioners is 8,645 rubles, which is 325 rubles more than the figure for 2022. The decision has already been made by the legislative body of the republic - the Kurultai.

The cost of living per child is also the determining indicator for child benefits. From January 1, 2022, this payment will be increased for most Russian parents. Previously, for benefits for children under 3 years old, one value was used - 50 rubles. Now, for the first and second child, an amount will be paid equal to the monthly minimum wage for children in the region for the 2nd quarter of the year preceding the year of application. The average per capita family income to receive benefits will be less than twice the minimum monthly wage of an able-bodied citizen in the region.
