An application for payment of funeral benefits must be accompanied by additional documents.

Note! A document required in all cases is a death certificate, which is issued by the civil registry office.

The rest of the list varies depending on who died:

  • If it is a stillborn, then you will also need an extract from the mother’s passport.
  • If we are talking about a deceased person who has not reached the age of majority (in a situation where both parents are unemployed), then you will need a death certificate, a document confirming registration at the place of residence, as well as an extract from the work books of the father and mother.
  • If a non-working citizen of working age or a pensioner has died, then the following will be required: a death certificate, registration paper at the place of residence, an extract from the deceased’s work record book and an extract from the applicant’s passport.
  • To receive a financial payment for the funeral of a person who did not have any place of residence during his lifetime, in addition to the death certificate, it is necessary to provide a death certificate and a certificate from the cemetery about the burial taking place indicating the grave number.

When purchasing funeral supplies, you should collect all receipts and receipts so that you can subsequently attach them to your application for “funeral items.”

The benefit has a fixed value (changes over time) and is set in the amount of the cost of the guaranteed list of funeral services, but not higher than the “minimum wage”, increased tenfold.

What documents are needed

The law states that only a death certificate must be presented for payment. In practice, they also include a death certificate and documents on relationship.

A death certificate in Form No. 11, approved by Order of the Ministry of Justice No. 200 dated October 1, 2018, is issued at the registry office or MFC on the basis of a medical death certificate issued in accordance with the recommendations of the letter of the Ministry of Health and Social Development No. 14-6/10/2-178 dated January 19. 2009 on medical documents and documents on the identity of the deceased. The latter document is also the basis for issuing a regular death registration certificate. In practice, a certificate in Form No. 11 is issued along with a medical certificate. Proof of funeral expenses is not required.

Features of forming an application form

An application for receiving a financial payment for a funeral at the place of work of the deceased currently does not have a single unified form, so it can be written in any form or according to a template (if any) provided by the organization to which the applicant applies. At the same time, regardless of which option is chosen, the only thing that needs to be taken into account is that the form, in its structure and content, meets certain rules and standards for the preparation of this type of documentation.

Let's start with the fact that the statement should be divided into three parts:

  1. beginning or “heading” - the addressee is indicated here, i.e. the name of the enterprise where the deceased worked, as well as information about the applicant: his full name, address, passport details.
  2. the main section is the actual request for payment of benefits, then information about the deceased. The applicant further indicates that he was actually involved in organizing the funeral and had never received a funeral benefit anywhere before. After this, you need to enter a list of documents confirming the person’s death and other documents necessary to receive benefits, attached to the application.
  3. conclusion - signature and date.

Where to apply for benefits

To receive payment, you must write a corresponding application for payment of benefits for the burial of an employee, relative or any other person, provided that the applicant has incurred funeral expenses. The specific place of appeal depends on the situation.

You only have 6 months to submit your documents. If the applicant does not make it in time, he will not receive this payment. Exception: when a person cannot physically submit such a document for valid reasons, it is necessary to challenge the refusal in court. In such a situation, it is imperative to prepare all documents indicating a valid reason.

Application Form

There are no special requirements for the design of the document, as well as for its descriptive part. This means that the application can be written by hand or printed on a computer (but with mandatory subsequent printing, since at the place of work it is accepted only in “live” form). An ordinary blank sheet of paper of any convenient format is suitable for the document (A4 or A5 are mainly used).

It is recommended to write the application in two identical copies ,

  • one of which should be given to the representative of the deceased citizen’s employer,
  • keep the second one, having previously endorsed the receipt of a copy from a representative of the enterprise.

Funeral benefit in 2022 in the system of direct payments from the Social Insurance Fund

In 2022, despite the transition of all employers to a system of direct payments from the Social Insurance Fund, funeral benefits are still paid by the employer with subsequent reimbursement of the amounts paid from the Social Insurance Fund. To receive compensation, the employer submits to the fund a death certificate and an application for reimbursement of benefits.

The FSS makes a decision within 10 working days from the date of receipt of the documents and no later than 2 working days transfers the money to the employer’s current account (clause 13, clause 16 of the Regulations on the specifics of the appointment and payment of insurance coverage in 2022, approved by Government Resolution dated 30.12 .2020 No. 2375).

How to send a document to an addressee

You can submit an application for payment of “funeral benefits” to the place of work of the deceased in several ways:

  • the first and most reliable - personally, from hand to hand to the addressee;
  • send it via regular mail by registered mail with return receipt requested (with a list of attachments) - this method also guarantees that the message will reach the recipient;
  • submit the application through a representative, but only if he has a valid, duly certified power of attorney from the applicant.

Where to get benefits for the funeral of a pensioner

In most regions of the Russian Federation, submitting an application for payment is allowed only to the branch of the Pension Fund of the Russian Federation where the pension file of the deceased is located. In Moscow, MFCs do not provide this service, but other Russian regions have their own rules, and the application is allowed to be submitted through the MFC. Upon the death of a veteran of the Great Patriotic War with a military rank, or a military pensioner, you should apply for payment to the military registration and enlistment office at your place of residence. It will not be possible to submit an application and receive benefits for the funeral of a pensioner through Gosuslugi; the portal contains only a description of the service and an appointment with the Pension Fund or MFC. This is due to the timing of the service.

Other payments to the Pension Fund

Compensation for funeral expenses is not the only money due to the relatives or heirs of a deceased pensioner. To figure out how to receive funeral money for a deceased pensioner in the form of a lost pension for the month of death, you need to clarify the pension transfer schedule. If the date of transfer of the pension for the month of death is later than the date when the person died, the Pension Fund is obliged to pay the pension to the heirs at their request. Only close relatives or heirs have the right to receive it upon application. In addition, the funded part of the pension is paid during work; this requires a separate application.

Where to submit documents

Documents are submitted:

  • to the Pension Fund of the Russian Federation, if this is a non-working pensioner;
  • to the territorial department of social protection of the population, if we are talking about a stillborn, minor or unemployed citizen.

Contact the employer directly:

  • persons who incurred burial expenses in the event of the death of an employee;
  • employees in the event of the death of a minor family member.

The procedure for social payments is as follows:

  1. An application is submitted from the relatives of the deceased employee to receive a funeral benefit in the name of the employer.
  2. The employer generates a payment order for social benefits, the funds are transferred on the day of application.
  3. The insurer submits a request for reimbursement of expenses to the territorial department of the Social Insurance Fund.

IMPORTANT!

Since 2022, all constituent entities of the Russian Federation have switched to direct payments from social insurance, but compensation for funeral costs is still paid by the employer at the request of the employee’s relatives. After payments, the policyholder applies to the Social Insurance Fund for reimbursement of expenses incurred.

Compilation rules

The procedure for writing a written appeal to an organization is regulated by the general norms of the Federal Law of January 12, 1996 No. 8-FZ “On Burial and Funeral Business,” in particular Article 10. When drawing up an application for a “funeral” benefit, you must follow the following recommendations for its form and content .

Form

Any unified request form for payment of benefits by the employer is not approved by law.

In this regard, the document is drawn up in any form . Often in practice, the template is provided by the accounting staff at the enterprise. The document can be written by hand or printed.

Content

First of all, you must indicate the official name of the employer to whom the document is addressed and enter the applicant’s information.

Then you need to write the name of the document indicating the type of benefit. In the case under consideration - “an application for payment of social benefits for the funeral of a minor.”

Next, the applicant should outline the essence of the appeal to the employer - the requirement for a monetary payment in connection with the death, as well as information about the deceased and family or other connections with him.

Grounds for payment and application deadlines

The basis for payment of benefits is an application for payment of funeral benefits and a package of documents that the applicant must submit.

To receive assistance, the applicant must submit an application to the head of the enterprise where the deceased was employed, or the head of one of the above-mentioned government services.

A person who has assumed the responsibility for organizing a funeral may apply for benefits within six calendar months from the date of death (clause 3 of Article 10 of Law No. 8-FZ of January 12, 1996).

Who has the right to submit documents and when?

Social payments are due to the person at whose expense the burial was carried out (8-FZ of January 12, 1996). Documents for compensation are submitted by:

  • spouse;
  • close and other (if there are no close) relatives;
  • legal representative.

The documentary basis for the transfer of funds is an application for payment of benefits for the employee's burial and the original death certificate from the registry office.

The amount of social payments from 02/01/2021 is 6424.98 rubles + regional coefficient. It is paid no later than six months from the death of the citizen, if an appeal has been made.
