Permission to conduct such activities is given to legal entities by the tax office. Legislative norms

The legal basis for the operation of a new type of cash register was Law No. 54-FZ of May 22, 2003, which prescribed the procedure for using cash registers in cash and electronic payments. According to Art. 4 of Law No. 54-FZ, a fiscal data operator is an intermediary organization that has received permission in the manner prescribed by law to process information from online cash registers. The main task of FD operators is to receive, process, transmit and store information about payment transactions. To solve it successfully, the FDO interacts:

  • with taxpayers, helping them to properly operate cash register systems and use additional opportunities for fiscalization of information;
  • with the Federal Tax Service inspections, transmitting information about the revenue received.

The installation of cash registers in stores that have a fiscal data recorder allowed tax officials to refuse to check primary documentation. Accordingly, taxpayers got rid of the unpleasant obligation to collect accounting documents confirming compliance with cash discipline.

Online checkouts are beneficial even for customers. They can check the received receipt at any time, make sure that all purchases are correctly reflected in it, and if violations are detected, contact the tax office with a complaint about the dishonest retail outlet.

List of OFD companies with permission from the Federal Tax Service

For organizations using an online cash register, concluding an agreement with the FD operator is mandatory. In this case, the choice of a specific operator remains with the taxpayer. The list of OFD is periodically updated, so before concluding a service agreement, make sure that the organization you like is included in it.

As of April 2022, there are 21 registered operators in the country that have official permission to process FD. The Tax Service regulates the work of the above organizations. It also “accepts” interested organizations as fiscal data operators in Russia. The list is formed on the basis of relevant orders of the Federal Tax Service.

"Astral.OFD" is an accredited fiscal data operator

Kaluga Astral has been operating since 1993. Will the list of operators be expanded?

The OFD register compiled by the tax office is not closed: it is constantly updated with new companies. Over the two years since Law No. 54-FZ came into force, the number of FD operators has increased from 16 to 21, that is, 1.3 times. Despite the fact that the main market players have already been named, experts expect that in the near future the largest retail companies will follow the example of Tander JSC (Magnit retail chain) and receive appropriate permission from the Federal Tax Service. Therefore, the answer to the question of how many fiscal data operators there are in Russia will probably change by the end of this year.

The opposite situation is also possible: if a company repeatedly violates the requirements of the law, it may be deprived of the right to engage in activities related to the processing of fiscal information and be excluded from the list. A company can also stop its FD processing activities on a voluntary basis.

What is OFD?

Summer 2016 Federal Law N 54-FZ officially came into force. Its provisions determine the gradual transition of all organizations and entrepreneurs in any taxation system that deal with cash and payments through payment cards to the use of so-called online cash registers. Their fundamental difference from conventional cash registers is the uninterrupted transmission to the tax service of information about the receipt and issuance of money at enterprises (via the Internet). Since the law affected all companies, regardless of the region of location and the choice of taxation procedure, business leaders became interested in the abbreviation OFD, which is often mentioned on the Internet.

OFD (fiscal data operator) is an organization that, under an agreement with enterprises of the Russian market, is obliged, for a fee, to receive, process, store and intermediary send fiscal data from the companies’ cash register to the tax service.

In many countries of the world, a similar scheme has been in effect for a long time; it has proven itself to be an excellent way to control taxpayers. As a result, the Russian Government also decided to introduce this mechanism for interaction between organizations and the Federal Tax Service in our country.

How to choose OFD

Today, the annual service fee for one online cash register is fixed - 3,000 rubles, so it will not be possible to find a “cheap” operator. The quality of the service provided also does not differ significantly, since almost all organizations on the Federal Tax Service list are experienced players in the telecommunications market. You will have to choose based on other criteria: the company’s reputation, ease of use of your personal account, quality of technical support, flexibility of interaction with the client. It is also useful to study the list of additional options provided by FD operators.

Therefore, if you are only interested in connecting an online cash register, choose any company that has permission from the Federal Tax Service. When you need to use additional services, check whether the chosen organization will provide them to you.

  3. Availability of fast payment by invoice and by bank card. This is important if the company constantly issues invoices to clients.
  4. Possibility of choosing tariff plans of various durations. Relevant for entrepreneurs engaged in seasonal business.
  5. "Single window" mode. A big plus is the ability to receive several services through one official OFD website.
  6. Reliability - the presence of negative reviews about the operator may indicate that the service is not functioning properly. For the taxpayer, this is fraught with large fines for late transfer of checks to the Federal Tax Service.

So how then to choose? In fact, who cares what here? For some, in addition to the basic OFD services, work with labeling is important. Some people really need marking monitoring and statistics, so they are willing to pay separately for advanced functionality using the Honest Sign. Someone absolutely needs to connect the OFD to 1C and needs an application for control. For some, inventory accounting and various types of reports are important. Some people find it convenient to work only from their phone. The criteria for choosing an operator are different for each entrepreneur.

If you think about which OFD is better to choose for an online cash register, then you can limit yourself to simple functionality. It is important that your personal account monitors cash register and financial statements, displays unsent receipts (if any) and the timing of drive replacement. If cash registers will help out a lot, the ability to group and report separately for each cash register. Common mistakes

Error No. 1: Ignoring the requirements of the Federal Tax Service for installing an online cash register at an enterprise and concluding an agreement for its maintenance with a fiscal data operator.

Comment: At the legislative level, the terms and procedure for the transition to new cash registers have been approved, which means that the installation of online cash registers and the signing of an agreement with the OFD are mandatory. Otherwise, it will not be possible to avoid fines, the amount of which is set at least 10 thousand rubles for officials and 30 thousand for legal entities.

Mistake #2: Concluding (extending) an agreement with a technical service center after installing an online cash register.

Comment: Upon purchasing an online cash register, companies are exempt from the mandatory conclusion of an agreement for servicing the cash register. Now you can call a technician only to check the working condition of the cash register or to repair it as necessary. From the moment of transition to new cash desks, it is necessary to conclude an agreement only with the fiscal data operator.

Error No. 3: The enterprise purchased, registered and registered a new online cash register, signed an agreement with the fiscal data operator, but did not deregister the old cash register with the Federal Tax Service.

Comment: A cash register that was used by a company before purchasing a new online cash register is subject to mandatory deregistration with the tax authority, as well as a cash register that was used by another company.

How to connect to the system

If a suitable FD operator is found, to connect you need:

  1. Receive a qualified electronic signature (CES). Typically, the company whose service you plan to use will be happy to produce you a CEP, which costs 1000–1500 rubles. If the OFD does not provide such a service, you can contact a certification center for a signature.
  2. Conclude an agreement to connect to the system with the OFD.
  3. Ensure a stable Internet connection at the retail point of sale.
  4. Purchase an online cash register with a fiscal drive. This can be done in specialized companies.
  5. Register a cash register on the Federal Tax Service website (get a registration number).

How checks get to the Federal Tax Service

The fiscal data operator works as follows:

  • The cashier generates a receipt at the online cash register at the time of sale
  • Payment information (receipt) enters the cash register memory (fiscal drive)
  • FN encrypts the received information
  • Online cash register prints a receipt
  • FN transmits data on the purchase made to the OFD
  • OFD receives a fiscal document (check), decrypts it and transmits it to the Federal Tax Service
  • How OFD transmits information about sales to the tax service

What else does the cash register convey to the operator:

  • online cash register registration reports (generated after connecting to the OFD)
  • reports on opening and closing shifts;
  • reports on the closure of financial funds;
  • reports on re-registration of cash registers, etc.

How to become an OFD

Current legislation allows only legal entities to obtain permission to work with fiscal data (Article 4.4 of Law No. 54-FZ). An individual entrepreneur cannot become a FD operator at the moment.

To be included in the list of fiscal data operators, the applicant company must submit an application to the Federal Tax Service. When checking the information provided, the tax office is obliged to make sure that the applicant:

  • complies with current legal requirements on the use of cash register systems;
  • has the necessary licenses to provide telematic communication services to legal entities;
  • will ensure the confidentiality and safety of the processed information.

When is it necessary to conclude an agreement with a fiscal data operator?

Without signing a cooperation agreement with the OFD, it is impossible to start using the online cash register, since the OFD is an intermediary between you and the tax service. This means that the timing of concluding an agreement with the OFD directly depends on the legal requirements regarding the timing of connecting online cash registers for individual entrepreneurs and legal entities on various tax systems:

  • For individual entrepreneurs and LLCs on OSNO and USNO:
  1. registration on a voluntary basis began on July 15, 2016;
  2. the forced transition to online cash registers for companies registering or re-registering cash registers ended on February 1, 2017;
  3. Registration will become mandatory starting from July 1, 2017, i.e. from this date, all cash registers must be serviced by the OFD.

Accordingly, you must conclude an agreement with the fiscal data operator before July 1 of the current year.

  • For individual entrepreneurs on PSN and UTII, as well as for LLCs on UTII, the presence of an online cash register will become mandatory from July 1, 2022, but it is possible to switch to working with it now.

This means that you need to sign the agreement and connect the cash register to the OFD before the first of July next year.

Requirements for applicants for OFD status

In addition to restrictions on the organizational and legal form, the applicant company is obliged to:

  • conduct activities in non-residential premises owned by it or leased. In this case, the premises must be reliably protected from unauthorized access, equipped with an alarm and video surveillance system, and serviced by a certified security company;
  • have at your disposal ultra-powerful modern equipment that allows you to process more than 10 thousand checks per second, a dedicated server, and a backup power system in case of power outages;
  • use only certified software;
  • have your own website with a first-level domain name;
  • obtain licenses from the FSB and FSTEC for cryptographic processing of confidential information.

Obviously, not every applicant company will receive the right to work as a fiscal data operator. The list of organizations authorized by the Federal Tax Service to process this type of information shows that only a large company can comply with all the requirements of the law.

The leading and most functional fiscal data operators named

In March 2022, the independent research agency Magram Market Research presented a market study and CRF rating.

The formation of the OFD market began in 2016, when the edition of Federal Law No. 54 “On the use of cash register equipment” came into force, obliging Russian retailers to use cash registers that transmit information about all trade transactions to the Federal Tax Service online through fiscal data operators (OFD).

As of February 2022, about 3.4 million online cash registers are registered with the Federal Tax Service of Russia - all of them must send fiscal data to the department.

In 2022, absolutely all Russian offline and online retailers, including individual entrepreneurs without employees, will be required to switch to such cash registers. This is due to the fact that on July 1, 2022, the final stage of the entry into force of the latest edition of Federal Law No. 54 “On the use of cash register equipment” will end.

Earlier, in 2022, Magram MR studied what Russian business thought about the 2016 cash reform and what difficulties entrepreneurs faced.

In March 2022, Magram MR presented a rating and analysis of the OFD market and assessed operators according to the criteria most relevant to consumers.

Of the 21 companies that have permission to process and protect fiscal data, 9 companies were included in the OFD rating, which, according to independent experts, study participants, and data from open sources, share 94.3% of the market.

Leaders in functionality

The issue of choosing a FDO has already affected or will affect in the near future every organization and individual entrepreneur engaged in retail trade or accepting online payments.

As noted by the authors of the study, a high degree of detail in the criteria that formed the basis of the OFD rating will help entrepreneurs in making an informed choice of a fiscal data operator, working with whom will not only bring the business into compliance with the requirements of 54-FZ, but will also bring a number of additional values.

Participants in the OFD rating were analyzed according to 53 criteria.

The groups of criteria important for consumers when choosing a basic OFD service - transfer of fiscal data included: ease of connecting the OFD service; ease of managing the OFD service, omnichannel support service and its quality; analytical reports on sales and additional functionality of the CRF service, useful for business.

Also, the OFD study and rating included criteria related to additional opportunities, solutions and services that are useful to OFD clients (offline and online retailers).

As part of the study, an analysis was carried out of the availability and quality of the participants in the OFD rating of a service for the fiscalization of online payments, EDI (electronic document management service), as well as solutions for working with labeled goods.

According to experts who took part in the study and the OFD rating, the availability of a service for the fiscalization of online payments by the fiscal data operator became relevant in connection with the pandemic, as a result of which retail, which had not previously planned to enter e-commerce, needed quick solutions for online fiscalization payments. Such solutions are necessary for retailers in case of delivery of goods to the buyer from a retail outlet, when creating their own online store or selling goods through social networks and mobile applications.

Criteria related to solutions for working with labeled goods were also noted in the OFD rating as relevant, in connection with the phased introduction of mandatory labeling, which will affect most product categories by 2024.

Fiscal data operators provide for their clients, offline and online retailers, the transfer of marking codes from receipts to the Honest Sign system, and also offer functionality for checking marking codes and tracking the status of their transfer.

Another important condition for working with labeled goods is the availability of electronic document management (EDF). The transfer of information about the movement of marked goods, if this movement is not accompanied by the issuance of a receipt, is technically ensured by the transfer of the marking code from electronic documents.

To achieve this, offline and online retailers need an electronic document management service. In this regard, the authors of the study included in the OFD rating criteria related to the availability and quality of the OFD, rating participants, and electronic document management service.

In accordance with the methodology described by the agency, all the criteria by which the participants in the OFD rating were assessed were identified using in-depth interviews with retailers in terms of the importance of these criteria when choosing a fiscal data operator.

The representation of each of the selected criteria among the OFD, the rating participants, with their aggregated assessment on a color scale, was assessed by experts - TsTO (maintenance centers for cash register equipment). These companies are the link between fiscal data operators and retailers.

CTOs are engaged in the sale, installation and configuration of cash registers for retailers. They often provide full support to their clients in terms of servicing the operation of cash desks and extending services for the transfer of fiscal data.

Owners of cash register machines need central service centers as qualified consulting services that can quickly, objectively and competently find answers to all questions related to the operation and control of cash register equipment.

As a rule, technical service centers cooperate with several fiscal data operators. For this reason, the CTO has a large accumulated expertise that allows you to compare the services of different OFDs.

Below is a comparative slide from a study based on the results of a comprehensive analysis of all 53 criteria considered.

As can be seen on the slide, the leaders of the OFD 2022 rating were: OFD.ru, Taxkom OFD and SBIS (Tensor).

Additionally, the study identified the most important criteria for retailers depending on the size of their business.

According to experts, according to criteria important for the largest retailers, OFD.ru has the greatest advantages. These criteria are presented to a somewhat lesser extent in Taksk OFD and SKB Kontur. The experts named Astral.OFD, Evotor OFD (Platform) and VLSI (Tensor) least often.

OFD.ru also became the leader in terms of representation and quality of criteria important for SME retailers - it was noted by 100% of the experts surveyed. Takskom OFD and Evotor OFD (Platform) received a slightly lower rating from experts. At the next level of the ranking in terms of the availability and quality of criteria important for SMEs were SKB Kontur and VLSI (Tensor).
